LA ROCHE COLLEGE Housing Application and Contract Fall and Spring Terms 2013 - 2014 |
| This Housing Contract is a legal agreement between the
individual student and/or parent, herein referred to as "Student," and
La Roche College, herein referred to as "College." |
| ELIGIBILITY - To be eligible to live in College Housing, an individual must be a full-time registered College student (minimum of 12 credits) in good standing with the Institution. If at any time during the term of this contract the Student’s status changes from full-time to less than full-time, or if the student’s eligibility is affected by proceedings under the Student Code of Conduct, this contract may be terminated by the College as set forth below. The College reserves the right not to accept an application for housing if the individual has been found in violation of residence hall policies. |
| CONTRACT TERM - This contract is for both the Fall and Spring terms while the College is in session and cannot be terminated except as set forth in this agreement. If this agreement is entered into after the start of the Fall term, this agreement applies only to the balance of the term(s) as applicable. If this contract is not returned to the Office of Housing and Residence Life by the specified due date, the College reserves the right to reject this contract. Once signed by the Student and accepted by the College, all provisions of the contract will be enforceable and shall remain in effect. If it is determined that the Student has an outstanding financial balance for current or prior terms, this contract may, at the option of the College, be declared null and void and the Housing Deposit may be applied by the College to the Student’s financial balance. |
| SECURITY DEPOSIT - Student agrees to pay a security deposit of $100 prior to taking possession of a room. This security deposit will be returned to Student upon termination of the Agreement if at such time: 1) Student’s room and common areas of the residence hall are found in the same condition as when the Student first took possession, normal wear and tear excepted; and 2) if the Student has settled in full all accounts and debts owing to the College, including, but not limited to, all charges, costs, assessments, fees and fines. |
| OCCUPANCY - The Student may not occupy College Housing during periods between academic terms, during the Thanksgiving holiday and Spring Break, and Easter Holiday unless prior permission is given by the Director of Housing and Residence Life. There is an additional charge to stay in College Housing during the times mentioned above. College Housing will not be available for occupancy prior to the check-in date announced. Students may not occupy College Housing other than as specified above. |
| LATE ARRIVAL - The Student must notify the Director of Housing and Residence Life in advance if his/her planned arrival date is later than the designated check-in date. Failure to do so may result in termination of this contract and forfeiture of the Housing Deposit. |
| VACATING - Residence halls must be vacated on the last day of the agreement, within 24 hours after discontinuance as a Student, termination of the contract by the College, or the student’s last final examination of the term, whichever occurs earliest. Upon request, graduating seniors may be permitted to stay until graduation day. The College may charge a penalty to any Student who fails to vacate College Housing when specified by the College. |
| ASSIGNMENTS - This Contract does not guarantee the right of assignment to or selection of a particular type of living accommodation. The College has the sole right to assign or reassign space, to assign roommates, to consolidate vacancies and to change occupancies as it deems to be necessary. |
| STUDENT CONDUCT - Each Student is responsible for knowing and observing College policies, rules and regulations as set forth in official College publications (Student Handbook). Student agrees to abide by (1) the terms of this Contract, (2) all laws and ordinances affecting the use and occupancy of College Housing, and (3) all College Regulations (including, but not limited to, the Student Handbook) pertaining to the College and/or College Housing, as the same presently exist or as amended by the College in its sole discretion from time to time. All College Regulations are hereby incorporated in and made a part of this contract as if set out in full herein. |
| PROHIBITED USES AND ACTIVITIES - Without limiting the Student Conduct requirements set forth above, Student hereby acknowledges that the following shall not be permitted in, on, or about the Student’s accommodations: unauthorized pets, air conditioners, space heaters, any open flame heating devices or open flame cooking device, hot plates, electric skillets, rice cookers, toaster ovens, George Forman grills, sandwich makers, crock pots and any other cooking appliance the College finds to be a fire hazard, halogen light fixtures, exterior radio/television aerials, controlled substances, waterbeds, loft beds, firecrackers, ammunition, firearms or any other weapons, and any flammable items. Extension cords are prohibited. (UL-approved power strips are permitted.) SMOKING IS NOT PERMITTED IN COLLEGE OWNED BUILDINGS. |
| COLLEGE ACCESS TO ROOMS - The College reserves the right to regulate the use of the residence hall in accordance with the policies of the College. Inspections may be held without prior notice to or consent from the Student to ensure compliance with those rules and regulations. The College shall have the right of access to all rooms for the purpose of making routine or emergency repairs as necessary without prior notice to or consent from the Student. Results of inspections may result in disciplinary action (including suspensions or dismissal from the residence halls) for violation of health and safety standards or conduct, or other disciplinary action for violation of College rules and regulations. |
| DAMAGES/LIABILITY - The Student is absolutely and unconditionally liable, individually and jointly with other occupants (residents), for whatever damage, regardless of cause, which occurs to the assigned accommodation and contents and furnishings therein. In all cases, the College's determination of the cost of repair shall be conclusive. Residents agree to pay for damages, lost or stolen College property, and/or service costs not due to normal wear and tear, and to the imposition of a financial hold on their account if the damage amounts are not paid. Damages or loss must be reported promptly to the residence staff. |
| Students will be billed for damage to the building and for damaged or missing furniture and equipment, including those in common areas, based on the cost of replacement, labor and/or materials. Charges will be divided and assessed equally between or among the residents of an accommodation unless one or more individuals accept responsibility for the charges. Damage charges which remain unpaid after the due date stated on the invoice may result in the cancellation of the current room accommodation and/or future consideration for housing accommodation and any other action deemed necessary for collection by the College. Each Student is required to complete the Room Condition/Inventory Forms within the stated time period. |
| The Student agrees that the College is not responsible for any damage or injury to the Student or his/her personal property from any act of another resident or any other person. The Student agrees that the College is not responsible or liable to the Student for any personal property that is lost, stolen or missing from College Housing. The Student shall be responsible for having adequate and appropriate insurance (i.e., homeowner’s supplemental insurance) to protect against any loss or damage to the Student’s personal property. Under no circumstances shall the College be liable for any damage or injury to the Student or any other individual or loss of personal property of a Student except where such damage or injury is caused by the negligence of the College or its employees. |
| KEYS - All keys are the property of the College and cannot be duplicated, exchanged or given to another person. Failure to return keys at the completion of the contract period will result in a penalty fee. There is also a charge for replacing lost keys during the term of this agreement. Keys found in the possession of anyone other than the person to whom they have been assigned will be confiscated. |
| TERMINATION BY STUDENT - The Student may terminate this contract for any of the following reasons: Completion of a withdrawal form in the Office of Housing and Residence Life no later than May 8th; withdrawal due to mid-year graduation; involuntary military service; marriage; or serious illness. In all cases, students who wish to withdraw from College Housing must complete a withdrawal form in the Office of Housing and Residence Life. If the Student complies with the requirements to terminate this Contract for one of the above-listed reasons, the Student will be refunded the full amount of his/her Housing Deposit minus any damage charges and will only be responsible for fees and charges for the term in which the termination occurs (except for withdrawals due to involuntary military service, in which case, the fees shall be prorated for the period of term during which College Housing is occupied). |
| ANY STUDENT WITHDRAWING FROM HOUSING DURING THE TERM OF THIS CONTRACT CANNOT CONSIDER HIS/HER WITHDRAWAL OFFICIAL UNTIL HE/SHE HAS HAD AN INTERVIEW WITH THE OFFICE OF HOUSING AND RESIDENCE LIFE AND HAS RETURNED HIS/HER KEY(S). |
| If you decide to terminate this agreement for terms other than listed above and after May 8, 2009, you will be assessed a $500.00 penalty fee. If you decide to terminate this agreement after move-in and during the Add Drop period (first two weeks of the Academic Semester) you will be charged $500.00 plus 10% of room and board for that academic semester and any fees and/or charges for the term. After the Add Drop period of the Academic Semester you will be charged $500.00 plus the remaining balance of room and board for that academic semester and any fees and/or charges for the term. Termination of this agreement between the Fall and Spring Academic Semester will assess a $500.00 fee for termination plus fees and/or charges for the term. |
| TERMINATION BY THE COLLEGE - The College may terminate this contract for any of the following reasons: Violation of any term or condition of this contract; Verified withdrawal, suspension or academic dismissal of the Student from the College; If the Student loses his or her housing privileges pursuant to proceedings under the Student Code of Conduct; or Behavior on the part of the Student which, in the opinion of the College, poses a clear and present danger to the Student, College community or community at large. In all cases, the Housing Deposit will be retained or charged by the College. In addition, the College may declare the entire amount of Fees (FALL and SPRING TERM), along with any other applicable charges, due under the contract to be immediately due and payable by the Student. Upon termination of this contract by the College, Student shall vacate College Housing in accordance with the terms specified by the College. |
| MARRIED COUPLES HOUSING - The College does not have
accommodations for housing married couples. |
| SINGLE BEDROOM RATE - The College will charge a student the rate for a single room if the student has a private bedroom. If a resident has a single bedroom, the student will have three options: 1) The first option is to pay the single bedroom rate for the semester to keep the private room. If the student chooses this option, the student will have their housing bill adjusted accordingly to reflect the single room rate, 2) The second option is for the student to find a roommate in order to keep the double room rate, or 3) The third option is to find a room with at least one other roommate that the student would like to relocate to in order to keep the double room rate. Notification of the student’s selected choice must be given to the Office of Housing and Residence Life within one week after the student’s room becomes a single bedroom. If notification of a choice is not given by the deadline, the student will be charged the single bedroom rate for the semester. |
| FOOD SERVICE - The College agrees to provide the Student such meals for which payment has been made. The Student agrees to abide by published regulations pertaining to the utilization of the food service. Unauthorized sale, acquisition, alteration, use or misrepresentation of the meal ticket (ID card) and unauthorized removal of property and/or food from the food service facility may result in disciplinary action including loss of food services privileges. In such an event, there shall be no refund or reduction of moneys due or paid to the College under this agreement. |

| STANDARD ROOM CHARGE for bold hall per semester is $3,080. Students permitted to purchase a single will pay an additional amount depending on the location of the single room. |
| Execution of this contract by the Student does not guarantee College Housing. Housing assignments are dependent upon space availability and behavioral issues. This contract shall be enforceable against the College when the College issues a College Housing assignment to the Student. This contract shall constitute a license and shall not be deemed to constitute a lease or to create or transfer interest in or lien on real estate. This contract may not be assigned or transferred. |

* Student agrees to pay a nonrefundable housing deposit of $100 prior to taking possession of a room. If a student notifies the Office of Housing and Residence Life no later than May 8th that s/he is not living on campus for the Fall Term, the College will terminate this contract and retain the housing deposit. After May 8th, Student may not cancel this contract except for the reasons stated herein. |
